More than 1,400 injured hip replacement patients who were excluded from an earlier $2.5 billion settlement due to the date of their replacement surgery have been extended compensation under an additional DePuy Orthopaedics settlement. Now, DePuy will pay up to $350 million to patients who underwent a revision surgery to replace their ASR XL hip implant before February 1, 2015—matching the same $250,000-per-patient benefit offered under the original settlement. $475 million in supplemental awards have also been offered as part of the total settlement package for those who were most severely harmed by the defective medical device. DePuy’s ASR XL metal-on-metal hip implants were recalled in 2010 after evidence of excessive and early failures, which the manufacturer’s analysts concluded amounted to a 40% failure rate in 5 years. The company will also cover medical expenses associated with revision surgery for all settling hip-replacement patients.
